USCIS Updates TPS Employment Authorization Guidance

Home care provider agencies with employees who have Temporary Protected Status (TPS) should be aware that the United States Citizenship and Immigration Services (USCIS) has updated its employment authorization guidance for several TPS designations.

For affected TPS beneficiaries whose employment authorization has been extended pursuant to court orders, USCIS currently instructs employers to use July 10, 2026 as the employment authorization expiration date for Form I-9 and E-Verify purposes.

Countries currently affected by this July 1, 2026 guidance include Burma (Myanmar), Ethiopia, Haiti, Somalia, South Sudan, Syria, and Yemen.

  • When completing or updating Form I-9, employers should enter “as per court order” in Section 1 and “July 10, 2026” in Section 2, along with a note in the Additional Information field.
  • When completing a case in E-Verify, employers should enter July 10, 2026 as the expiration date from Form I-9.

HCP strongly encourages providers to check USCIS I-9 Central and the applicable country-specific TPS webpage regularly for updates. Agencies may also download and attach the relevant USCIS alert and TPS webpage to the employee’s Form I-9 file.

Because the legal status of these extensions remains fluid, providers must consult immigration counsel or qualified employment counsel with questions about specific employees or workforce actions.
